This morning the Prime Minister of Canada, Justin Trudeau, has resigned. IAB Canada has been actively working on several files impacting the Canadian Digital Media sector and this move will have significant impact on their status. With the Prime Minister announcing of the proroguing of Parliament, all files including Bill C-27 (which involves PIPEDA’s replacement, the Consumer Privacy Protection Act, and the Artificial Intelligence and Data Act) have died. PIPEDA remains in force in Canada, most likely until 2026. Until then, no effort was wasted and our work to bring the digital media sector into compliance with the GDPR, Law 25 and emerging privacy regulations in the US, continues to serve the industry.
While privacy has been a key focus, there are other bills impacted by this turn of events. This includes Bill C-252 – An Act to amend the Food and Drugs Act (prohibition of food and beverage marketing directed at children) – a challenging bill that would have major compliance costs attached to it.
Although we face some regulatory uncertainty in the coming weeks and months ahead, our focus will remain on continuing to develop and enhance Privacy Enhancing Technology (PETs) and other technical solutions to ensure the industry is ahead of the curve and operating to meet international standards. We will also be prepared to offer our Elections database solution to ensure advertisers and publishers are able to navigate registry requirements associated with the Election Act.
IAB Canada will continue to monitor this situation and will update you on the status of the DST and other issues that are sure to arise from the fallout of the Prime Minister’s resignation.
